Master Travel Services Agreement

These Terms and Conditions ("Agreement") govern your use of the Aerie Travel Studio website, located at www.aerietravel.com, and all travel planning, consulting, reservation, and booking services provided by Aerie Travel Studio ("Aerie Travel Studio," "Aerie," "we," "our," or "us").

By accessing our website, requesting travel planning services, paying a planning fee, submitting payment for travel, or making any booking through Aerie Travel Studio, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree, please discontinue use of our website and services.

1. WHO WE ARE

Aerie Travel Studio is operated by Montse Aguilar, an independent travel advisor affiliated with Fora Travel, Inc. ("Fora"), a host agency and technology platform.

Aerie Travel Studio operates independently.

Client acknowledges that:

  • Fora is not a travel provider.

  • Fora is not a party to this Agreement.

  • Fora does not own or control Aerie Travel Studio.

  • Fora is not responsible for travel planning decisions, recommendations, bookings, supplier performance, disputes, refunds, cancellations, or damages arising from services provided by Aerie Travel Studio.

To the fullest extent permitted by law, Client releases Fora from any claims arising from services provided by Aerie Travel Studio.

2. ELIGIBILITY

By using our website or services, you represent that:

  • you are at least eighteen (18) years old;

  • you possess legal authority to enter contracts;

  • you are authorized to act on behalf of every traveler included in your reservation;

  • all information you provide is complete and accurate;

  • you will promptly notify us of any changes.

You accept responsibility for communicating these Terms to every traveler included in your booking.

3. OUR SERVICES

Aerie Travel Studio provides professional travel planning and reservation services.

Services may include:

  • itinerary design

  • hotel reservations

  • cruises

  • escorted tours

  • independent travel

  • airfare assistance

  • transfers

  • vacation packages

  • excursions

  • restaurant reservations

  • travel consulting

  • destination recommendations

  • concierge assistance before departure

Our role is limited to researching, recommending, arranging, and booking travel services requested by you.

We do not own, operate, manage, or control airlines, cruise lines, hotels, tour operators, transportation providers, insurance companies, or any other travel suppliers.

4. PLANNING FEES

Certain services require a professional planning fee.

Planning fees compensate Aerie Travel Studio for research, consultation, itinerary development, supplier coordination, and professional expertise.

Unless otherwise agreed in writing:

  • planning fees are due before work begins;

  • planning fees are non-refundable;

  • planning fees are earned upon receipt;

  • planning fees remain non-refundable even if travel is cancelled, modified, postponed, or never booked.

Supplier refunds do not include reimbursement of planning fees.

5. WEBSITE USE

Unless otherwise stated, all content on this website—including text, graphics, logos, photographs, itineraries, travel guides, downloadable materials, branding, and design—is the intellectual property of Aerie Travel Studio or its licensors.

You may use this website solely for personal, non-commercial purposes.

You may not:

  • copy website content;

  • reproduce itineraries;

  • republish articles;

  • sell our materials;

  • distribute our content;

  • scrape website information;

  • reverse engineer website functionality;

  • use our branding without written permission.

Unauthorized use may result in legal action.

6. COOKIES

Our website uses cookies and similar technologies to improve performance, personalize user experience, analyze website traffic, and support marketing efforts.

Some cookies are essential for website functionality and cannot be disabled.

By using our website, you consent to our use of cookies as described in our Privacy Policy.

7. USER CONTENT

If our website permits reviews, testimonials, comments, photographs, or other submissions, you retain ownership of your content.

However, you grant Aerie Travel Studio a perpetual, worldwide, royalty-free license to display, reproduce, modify, publish, and distribute that content in connection with our business.

You represent that:

  • you own the content;

  • you have permission to post it;

  • it violates no law;

  • it infringes no intellectual property rights;

  • it is not defamatory, obscene, fraudulent, or misleading.

We reserve the right—but not the obligation—to remove any content at our discretion.

8. LINKS TO OUR WEBSITE

Reasonable links to our homepage are permitted provided they:

  • are not misleading;

  • do not imply endorsement;

  • do not damage our reputation;

  • accurately identify Aerie Travel Studio.

We reserve the right to require removal of any link at any time.

9. THIRD-PARTY WEBSITES

Our website may contain links to third-party websites.

These websites are operated independently.

We are not responsible for:

  • website content;

  • privacy practices;

  • security;

  • accuracy;

  • products;

  • services.

Accessing third-party websites is at your own risk.

10. TRAVEL SUPPLIERS

All travel services are provided by independent suppliers.

These may include:

  • airlines

  • cruise lines

  • hotels

  • resorts

  • rail operators

  • transportation companies

  • tour operators

  • insurance providers

  • destination management companies

  • activity providers

Each supplier maintains its own:

  • pricing

  • inventory

  • schedules

  • cancellation policies

  • refund rules

  • baggage rules

  • health requirements

  • operational procedures

Supplier terms become part of your booking and govern the services purchased.

11. OUR RECOMMENDATIONS

We make recommendations using information reasonably available at the time of booking together with your stated preferences, budget, travel goals, and available inventory.

Travel experiences are inherently subjective.

Accordingly, we cannot guarantee:

  • satisfaction with any supplier;

  • hotel quality;

  • room location;

  • cabin location;

  • weather;

  • destination conditions;

  • airline schedules;

  • cruise itineraries;

  • sightseeing availability;

  • special requests;

  • supplier performance.

Recommendations are professional opinions rather than guarantees.

12. PRICING

Unless stated otherwise, all prices are quoted in U.S. Dollars.

Travel pricing changes constantly.

Quoted prices are not guaranteed until:

  • required deposits are paid;

  • reservations are confirmed by suppliers;

  • written confirmation is issued.

Price increases may occur because of:

  • supplier repricing;

  • currency fluctuations;

  • fuel surcharges;

  • taxes;

  • government fees;

  • availability changes.

We are not responsible for supplier pricing changes occurring before confirmation.

If an obvious pricing error occurs, we reserve the right to correct the error before confirming the reservation.

13. PAYMENTS

Payment deadlines are established by individual suppliers.

Failure to make payments when due may result in:

  • automatic cancellation;

  • loss of deposits;

  • supplier penalties;

  • increased pricing;

  • reduced availability.

We are not responsible for supplier cancellations caused by missed payment deadlines.

Client authorizes payment processing through suppliers or Fora when applicable.

All credit cards provided must belong to an authorized user.

Fraudulent payment methods will result in immediate cancellation of services.

14. CREDIT CARD AUTHORIZATION

By providing payment information, Client authorizes charges that have been expressly approved for travel services, deposits, final payments, planning fees, supplier-imposed charges, and applicable service fees.

Client agrees not to initiate a chargeback except in cases of unauthorized charges, fraud, or where otherwise permitted by applicable law.

Before disputing any charge, Client agrees to notify Aerie Travel Studio and allow a reasonable opportunity to resolve the matter with the responsible supplier.

15. CLIENT REVIEW OF TRAVEL DOCUMENTS

Upon receiving confirmations, itineraries, invoices, tickets, cruise documents, hotel confirmations, or travel vouchers, Client must carefully review every document.

This includes verifying:

  • traveler names;

  • dates;

  • destinations;

  • passport information;

  • room categories;

  • cabin categories;

  • pricing;

  • flights;

  • transfers;

  • special requests.

Any discrepancy must be reported within 24 hours of receipt.

Failure to do so may result in supplier penalties, change fees, or cancellation charges for which Aerie Travel Studio is not responsible.

16. CLIENT RESPONSIBILITIES

Client is solely responsible for:

  • providing accurate traveler information;

  • making timely payments;

  • obtaining passports and visas;

  • complying with health requirements;

  • reviewing travel documents;

  • understanding supplier terms;

  • arriving on time for transportation;

  • obeying local laws;

  • maintaining appropriate conduct during travel.

Independent travel arrangements booked outside Aerie Travel Studio remain solely the Client's responsibility and are not covered by our services.

17. PASSPORTS, VISAS, HEALTH & ENTRY REQUIREMENTS

Client is solely responsible for obtaining and maintaining all travel documents required for their itinerary, including passports, visas, vaccination records, health certificates, parental consent forms, and any other entry or transit documentation.

For international travel, passports should generally be valid for at least six (6) months beyond the travel dates unless the destination requires otherwise.

Travel requirements may change without notice. Aerie Travel Studio does not guarantee the accuracy of government entry requirements after the time of booking.

Failure to obtain proper documentation may result in denied boarding, denied entry, quarantine, missed travel, or financial loss, for which Aerie Travel Studio shall not be liable.

Travelers with criminal convictions or other legal restrictions are responsible for determining whether they are eligible to enter or transit through any destination.

18. HEALTH REQUIREMENTS

Client is responsible for determining and complying with all applicable health, vaccination, testing, medication, and medical entry requirements for each destination.

Aerie Travel Studio does not provide medical advice and recommends consulting the appropriate governmental authorities and healthcare professionals before travel.

Clients are responsible for ensuring they are medically fit to travel.

19. SPECIAL REQUESTS

Requests for adjoining rooms, connecting cabins, bed configuration, dietary accommodations, accessibility accommodations, celebrations, early check-in, late checkout, cabin location, room location, or similar preferences are requests only.

Unless expressly confirmed in writing by the travel supplier, special requests are not guaranteed.

Failure of a supplier to accommodate a request does not constitute a breach of this Agreement.

20. TRAVEL INSURANCE

Travel insurance is strongly recommended for every traveler.

Unless expressly purchased, no travel insurance is included with your booking.

Aerie Travel Studio recommends comprehensive coverage that includes, where available:

  • Trip cancellation

  • Trip interruption

  • Medical expenses

  • Emergency medical evacuation

  • Baggage loss or delay

  • Travel delays

  • Supplier insolvency

  • Cancel For Any Reason (CFAR), if desired and available

If Client declines travel insurance, Client accepts full financial responsibility for any losses resulting from cancellations, illness, injury, weather, supplier bankruptcy, missed connections, government actions, or other unforeseen events.

Aerie Travel Studio is not an insurance company and does not guarantee coverage under any policy.

21. CHANGES, CANCELLATIONS & REFUNDS

All bookings are subject to the cancellation, modification, refund, and deposit policies of the applicable travel supplier.

Client agrees to submit cancellation or modification requests in writing.

Whenever reasonably possible, requests should be submitted at least forty-eight (48) hours before supplier deadlines.

Aerie Travel Studio cannot guarantee that suppliers will approve changes or refunds.

Supplier penalties may include the loss of deposits or the full value of the reservation.

Any additional costs, supplier fees, rebooking charges, fare differences, or service fees arising from changes requested by Client are the sole responsibility of the Client.

Planning fees remain non-refundable.

22. AIRLINE SCHEDULE CHANGES & TRANSPORTATION

Airlines, cruise lines, rail operators, and other transportation providers may change schedules, aircraft, vessels, routes, airports, ports, or departure times without notice.

Client is responsible for reviewing transportation schedules prior to departure.

Aerie Travel Studio is not responsible for:

  • Flight delays

  • Flight cancellations

  • Missed connections

  • Schedule changes

  • Seat assignments

  • Airline operational decisions

  • Overbooking

  • Baggage handling

  • Missed cruise embarkation

Clients should allow adequate connection time and are encouraged to purchase travel insurance covering transportation disruptions.

23. FORCE MAJEURE

Aerie Travel Studio shall not be liable for delays, interruptions, cancellations, losses, or failure to perform resulting from events beyond its reasonable control, including but not limited to:

  • Natural disasters

  • Severe weather

  • Hurricanes

  • Earthquakes

  • Floods

  • Wildfires

  • Pandemics

  • Epidemics

  • Government actions

  • Travel restrictions

  • War

  • Terrorism

  • Civil unrest

  • Labor strikes

  • Supplier insolvency

  • Cyberattacks

  • Transportation failures

  • Utility outages

  • Acts of God

  • Any other unforeseen event beyond our reasonable control

In such circumstances, refunds and credits are governed solely by supplier policies and applicable travel insurance.

Aerie Travel Studio will make reasonable efforts to assist Clients in obtaining available remedies but does not guarantee any particular outcome.

24. LIMITATION OF LIABILITY

Aerie Travel Studio acts solely as an intermediary between Clients and independent travel suppliers.

We do not own, operate, supervise, or control any travel supplier.

Accordingly, to the fullest extent permitted by law, Aerie Travel Studio shall not be liable for any injury, death, property damage, delay, inconvenience, loss, expense, disappointment, emotional distress, or other damages arising from:

  • Supplier acts or omissions

  • Transportation delays

  • Mechanical failures

  • Weather

  • Government actions

  • Border decisions

  • Illness

  • Criminal acts

  • Force majeure events

  • Supplier bankruptcy

  • Changes made by suppliers

  • Failure of suppliers to honor reservations

  • Failure of suppliers to fulfill special requests

Nothing in this Agreement limits liability that cannot legally be limited under applicable law.

To the fullest extent permitted by law, Aerie Travel Studio's total liability arising from any claim shall not exceed the total planning fees and commissions actually received by Aerie Travel Studio in connection with the specific booking giving rise to the claim.

25. WEBSITE DISCLAIMER

The information provided on our website is for general informational purposes only.

Although we strive for accuracy, travel information changes frequently.

We do not warrant that website content is complete, current, or error-free.

Website availability is not guaranteed, and we reserve the right to modify, suspend, or discontinue any portion of the website at any time without notice.

26. PRIVACY

Our collection and use of personal information is governed by our Privacy Policy.

By using our website or services, Client consents to the collection, storage, and use of personal information necessary to arrange travel, communicate regarding bookings, comply with supplier requirements, and operate our business.

27. ELECTRONIC COMMUNICATIONS

Client agrees that communications by email, text message, electronic forms, online portals, or other electronic means satisfy any legal requirement that communications be in writing.

Electronic acceptance of these Terms and Conditions shall have the same legal effect as a handwritten signature.

28. TESTIMONIALS & PHOTOGRAPHS (OPTIONAL)

If Client voluntarily submits reviews, testimonials, photographs, or travel experiences to Aerie Travel Studio, Client grants Aerie Travel Studio a non-exclusive, royalty-free license to use such materials for marketing, promotional, and educational purposes unless Client requests otherwise in writing.

Aerie Travel Studio will not identify Clients by full name.

29. DISPUTE RESOLUTION

The parties agree to attempt to resolve any dispute through good-faith negotiations before initiating legal proceedings.

If a dispute cannot be resolved informally within thirty (30) days after written notice, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Arbitration shall take place in Dakota County, Minnesota, unless otherwise required by applicable law.

The arbitrator's decision shall be final and binding.

Each party shall bear its own attorneys' fees unless otherwise awarded by the arbitrator or required by law.

30. CLASS ACTION WAIVER

To the fullest extent permitted by law, all claims shall be brought solely on an individual basis.

Neither party may participate in any class action, collective action, representative action, or consolidated proceeding relating to this Agreement.

31. LIMITATION PERIOD

Any claim arising out of this Agreement must be commenced within one (1) year after completion of the travel giving rise to the claim, or within the shortest period permitted by applicable law.

Claims filed after that period are barred.

32. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Minnesota, without regard to its conflict of law principles.

For matters not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Dakota County, Minnesota.

33. CHANGES TO THESE TERMS

Aerie Travel Studio may update these Terms and Conditions from time to time.

The version in effect at the time a booking is confirmed shall govern that booking unless otherwise agreed in writing.

Updated versions will apply prospectively to future bookings and website use.

34. GENERAL PROVISIONS

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure to enforce any provision shall not constitute a waiver of that provision.

This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior oral or written representations relating to the services provided.

This Agreement may not be assigned by the Client without Aerie Travel Studio's written consent.

Any provisions that by their nature should survive termination—including payment obligations, limitation of liability, dispute resolution, arbitration, intellectual property rights, and indemnification—shall survive completion or termination of the travel services.
